500% more Asian Partners than Those Black Backgrounds

| General

A recent Report released to mark Black History Month and supported by industry leaders from the Black Solicitors Group, profession regulator the Law Society and numerous providers of legal services has found that there were around five hundred per cent more Asian partners than those emanating from black backgrounds and approximately one per cent of those who have achieved the accolade of promotion to partner level emanate from Black and Minority Ethnic backgrounds.

Survey Sample?

As everybody who has attempted to digest the results of any survey of this nature is more than aware, the credibility, weight and strength of a set of results rises and falls on the basis of its survey sample. This survey was absolutely no exception and in this regard the organisers of the survey approached, questioned and gathered data from just shy of fifteen thousand respondents all of whom had seemingly climbed the greasy pole of the legal profession and achieved the position of partner within a law firm.

Our Survey Said…

After the organisers of the survey had established the credibility of its own data it revealed a number of troubling findings concerning the plight of partners deriving from black and minority ethnic backgrounds. It found the following:

  • as the headline eluded earlier to only one per cent of the total number of partners working in law firms appear to emanate from black and minority ethnic backgrounds

  • just under four per cent of the total inhabitant populous of the entire England and Wales jurisdiction

  • surprisingly there are five hundred per cent more of those deriving from Asian backgrounds who had achieved partner status than those persons from the Black demographic

  • many perceived that they would not be under more coercion, compulsion and oppression to blend in with other racial demographics

  • others feared that due to the racial demographic they belonged to they would subjected to greater a stronger spotlight being shone on them compared to others from a white racial demographic

  • some shared thoughts that they were being or would be provided with a lower standard of work by the legal services provider employing them due to their personal racial demographic

  • several of those who responded to the questions put forward by the organisers of the survey commented their belief that due to their racial demographic they would find themselves cut off, forlorn and isolated from influential networks within the profession and

  • a proportion of respondents felt the perception of being on the periphery of the profession due to their racial demographic

Pathway Forward?

The organisers of the Black History Month Report helpfully put forward to some suggestions as to how this situation could be alleviated to mitigate against the risk of these alarming numbers from being repeated or in fact worsening in future years. The suggested:

  • making a top priority the aligning of policies on equality, diversity and inclusivity to pay provided to the upper echelons of businesses

  • mitigating the risk of partiality in the assignment of work and put forward ideas for doing so by mixing technological solutions with members of the workforce

  • closely monitoring, assessing, interpreting the data and advising such businesses to make it a contractual requirement when doing business with potential supply chain organisations

  • acting to bridge the gap of disparity at partner level between those emanating from black backgrounds and other ethnic minorities and

  • providing training to members of the workforce and going further by creating an inclusive culture.

Taking this action this will mitigate the risk of these alarming statistics being repeated in future years.
