Proactive Lawyers in Sports Law

Many football disputes are resolved behind closed doors. This because there is often the need to be amicable so to no disrupt the team harmony and function. The demands of star players are often acquiesced to. 

To resolve a dispute, lawyers play a crucial role. The following is the type of work possibly expected of a lawyer during a footballing dispute: 

  • Negotiation and mediation: The lawyer could engaged in negotiations with the club's representatives to find a mutually agreeable solution. They might explore options such as a revised payment structure or alternative compensation to address issues. 
  • Drafting settlement agreements: If the parties decided to settle the dispute outside of court, the lawyer would draft a settlement agreement that outlines the terms and conditions of the resolution. This agreement would ensure that both parties are satisfied and that the dispute is fully resolved, without it impacting the team too much. 
  • Litigation support: If the case went to court, the lawyer would represent a player’s interests, presenting arguments, evidence, and legal precedents to support any claim. 

To be proactive, it may be helpful to 

  • Use clear and specific language: When drafting a contract, a lawyer can ensure that the terms and conditions are clearly stated and leave no room for ambiguity in the context of a footballing environment. This could be the bonuses due to paid to a young player who achieves their potential. The important element here is to gauge what success means from their starting point.
  • Anticipate future scenarios: A lawyer can work closely with their client to understand their goals and objectives. Lawyer’s must also be proactive in identifying clauses which protect a player’s financial or sporting interest, ie through ensuring a release clause is added into a deal.
  • Conduct regular contract reviews: in line with the above, it is important for a lawyer to periodically review and update contracts to ensure they remain relevant and reflect any changes in circumstances or laws. A footballing career is dynamic, and 6 months of good form can change a player’s entire fortune.
